Terms & Conditions

1. Intermediary (Platform Only) Status Saaf likhein ki Aaxzo sirf ek "Technical Bridge" hai. Hum na toh saaman bech rahe hain, na rent par de rahe hain. Asli contract Owner aur Renter ke beech hai. 2. "As-Is, Where-Is" Basis Renter saaman ko "jaisa hai, waisa hi" accept karta hai. Saaman lene ke baad renter ye claim nahi kar sakta ki "ye chiz purani thi" ya "isne mera kaam kharab kar diya." 3. Verification Liability Disclaimer Hum KYC (Aadhaar/ID) ki copy lete hain, lekin hum unki physical background checking ya criminal history ki guarantee nahi lete. User ko transaction se pehle khud satark rehna hoga. 4. Limitation of Liability (₹0 Damages) Kisi bhi accident, chot, ya maut (e.g., rent ki bike ka accident) ki surat mein Aaxzo par koi case nahi ho sakta. Hamari liability sirf hamari "Service Fee" tak hi limited hogi. 5. Indemnification (Ulat-Vaar Clause) Agar kisi user ki galti (e.g., owner ne chori ka saaman list kiya) ki wajah se police Aaxzo ko pakadti hai, toh us user ko Aaxzo ka saara legal kharcha aur jurmana bharna padega. 6. No Employer-Employee Relationship Aaxzo par jo bhi service dene wale hain (e.g., plumbers ya drivers), wo Aaxzo ke employees nahi hain. Wo "Independent Contractors" hain. 7. Digital Signature Acceptance Jab user "I Agree" par click karta hai ya OTP daalta hai, toh use "Electronic Signature" (IT Act 2000) maana jayega aur wo court mein utna hi valid hoga jitna paper sign. 8. Handling Criminal Breach of Trust Agar koi saaman lekar bhagta hai, toh Aaxzo use sirf "Civil Dispute" nahi balki "Criminal Offence" maunega aur owner ko FIR ke liye poora data support dega. 9. Right to Terminate/Ban Aaxzo ke paas bina kisi wajah bataye kisi bhi user ka account suspend ya permanently ban karne ka pura haq hai. 10. Security Deposit Management Aaxzo sirf ek "Escrow" (beech-ka-rasta) ka kaam karega. Security deposit kab rokna hai aur kab wapas karna hai, iska antim faisla (final decision) Aaxzo ke pass rahega agar dispute hota hai. 11. Force Majeure (Halaat ke Maare) Agar baarish, dange, ya lockdown ki wajah se saaman wapas nahi ho paya, toh uske liye kisi party ko "Default" nahi maana jayega, par communication zaroori hai. 12. Data Privacy & DPDP Act Compliance Hum user ka data (Phone, ID, Photos) sirf transaction ke liye use karenge. Hum ise kisi third party ko nahi bechenge, magar police/law enforcement ko mangne par denge. 13. Intellectual Property Protection Aaxzo.com ka naam, code, UI/UX, aur database hamari property hai. Users hamari site se data "scrape" (copy) nahi kar sakte. 14. Exclusive Jurisdiction Kisi bhi legal lafde ki sunwai sirf [Aapke Shehar] ki court mein hogi. Renter ya Owner kisi dusre shehar ki court mein Aaxzo ko nahi ghasit sakta. 15. Arbitration Clause (Out-of-court settlement) Court jane se pehle dono parties ko Aaxzo dwara niyukt (appointed) ek Arbitrator ke paas jana hoga. Isse company ka saalon ka court ka chakkar aur paisa bachega. 16. Sub-Lending Prohibition (Aage rent par dena mana hai) Renter saaman ko aage kisi aur ko rent par nahi de sakta. Agar woh aisa karta hai aur saaman ko kuch hota hai, toh saari zimmedari aur harjana Renter ka hoga, aur unpar legal action liya jayega. 17. Ownership vs. Possession (Maaliki haq) Ye saaf likhein ki rent par saaman lene ka matlab sirf "istemal ka haq" (Possession) hai, "maaliki haq" (Ownership) nahi. Renter us saaman par koi loan nahi le sakta aur na hi use girvi (Pawn) rakh sakta hai. 18. Usage Guidelines (Sahi istemal) Owner saaman ke saath "Usage Manual" ya "Rules" de sakta hai (e.g., "Ye camera barish mein use na karein"). Agar Renter rules todta hai, toh insurance ya damage protection claim cancel ho jayega. 19. Privacy of Third Parties (Recording/CCTV) Agar koi venue (farmhouse) ya car rent par de raha hai, toh Owner ko disclose karna hoga ki wahan koi CCTV ya GPS tracker laga hai ya nahi. Bina bataye recording karna "Privacy Violation" ka case ban sakta hai jisme Aaxzo ko ghaseeta ja sakta hai. 20. Tax Responsibility (GST/Income Tax) Aaxzo sirf apni service fees par GST bharega. Owner jo rent kama raha hai, us par tax bharna Owner ki apni zimmedari hai. Aaxzo unka tax consultant nahi hai. 21. Content Moderation (Images & Language) Owner jo photos aur description daal raha hai, usme kuch bhi ashleel (obscene), copyright wala, ya bhadkau nahi hona chahiye. Aaxzo ke paas aisi listings ko turant hatane ka haq hai. 22. Refund & Cancellation Window Ek fixed time frame hona chahiye. Jaise: "Delivery se 24 ghante pehle cancel kiya toh 50% refund, aur agar delivery ke waqt mana kiya toh 0% refund." Isse fake bookings rukengi. 23. Abandoned Property (Bhoola hua saaman) Agar Renter saaman wapas karte waqt apna koi personal saaman (e.g., car mein phone ya bag) bhul jata hai, toh Aaxzo ya Owner uske liye zimmedar nahi honge. 24. Dispute Resolution Period Koi bhi shikayat (complaint) rental period khatam hone ke 48 ghante ke andar karni hogi. Uske baad Aaxzo ye maan lega ki deal sahi-salamat puri ho gayi hai aur payment release kar dega. 25. Fair Wear and Tear (Aam ghisaavat) Saaman use karne se jo thodi-bohot purani dikhne lagti hai (normal wear and tear), uske liye Renter se paise nahi liye jayenge. Sirf "Asli Damage" (tutna, jalna, khona) par hi fine lagega. 26. Non-Poaching Clause (Direct Deal ki Manaahi) Point: Agar koi Renter aur Owner Aaxzo par mile hain, toh woh Aaxzo ko bypass karke bahar-bahar (offline) deal nahi kar sakte. Protection: Agar woh aisa karte hain aur pakde jaate hain, toh unpar bhari fine lagega aur unka account ban ho jayega. Ye aapke commission (revenue) ko bachane ke liye hai. 27. Insurance Disclaimer Point: Aaxzo kisi bhi saaman ka insurance nahi deta. Owners ko salaah di jaati hai ki woh apna saaman khud insure karwayein. Protection: Agar koi car ya mehnga camera chori ho jaye, toh Owner Aaxzo se insurance ka paisa nahi maang sakta. 28. Vicarious Liability (Dusre ki galti ka bojh) Point: Agar Renter koi rented gaadi chala raha hai aur usse kisi ka accident ho jata hai, toh Aaxzo ya Owner "Vicarious Liability" (dusre ki galti ki zimmedari) ke tehat zimmedar nahi honge. Protection: Ye aapko third-party personal injury claims se bachata hai. 29. Survival Clause Point: Agar Renter account delete bhi kar deta hai, toh bhi "Damage Liability" aur "Indemnity" wale rules us par tab tak lagu rahenge jab tak purani deals puri na ho jayein. Protection: User galti karke account delete karke bhaag nahi sakta. 30. Modification of Terms Point: Aaxzo ke paas haq hai ki woh kabhi bhi apne rules (T&C) badal sake. Naye rules website par publish hote hi lagu ho jayenge. Protection: Aapko har user ko phone karke batane ki zaroorat nahi padegi. 31. Right to Inspect (Nirikshan ka haq) Point: Agar Owner ko lage ki uske saaman ka galat istemal ho raha hai, toh woh Renter ko notice dekar (ya Aaxzo ke zariye) apna saaman check karne ka haq rakhta hai. Protection: Saaman ko buri tarah damage hone se pehle bachane ke liye. 32. Verification Accuracy Point: Agar koi user galat ID proof ya fake documents deta hai, toh Aaxzo unpar "Fraud" ka legal case file kar sakta hai. Protection: Users ko dar rahega ki fake ID se login na karein. 33. Severability (Hissa Alag Karne ka Niyam) Point: Agar kal ko court kahe ki aapka koi ek point (maan lijiye Point 5) galat hai, toh sirf wahi point hatega, baaki poora agreement (Point 1 to 32) valid rahega. Protection: Ek galti ki wajah se aapka poora contract zero nahi hoga. 34. Anti-Harassment & Communication Point: Renter aur Owner ek dusre ko gali-galoch ya pareshan (harass) nahi karenge. Saari communication professional honi chahiye. Protection: Platform ke mahaul ko safe rakhne ke liye. 35. User Content Royalty-Free License Point: Jo photos Owners apne saaman ki dalenge, Aaxzo unhe marketing aur ads ke liye use kar sakta hai bina Owner ko paise diye. Protection: Aapko apni site ki branding ke liye alag se photo-shoot nahi karwana padega. 36. Hazardous & Illegal Goods (Khatarnak Saaman) Point: Owners koi bhi aisa saaman list nahi kar sakte jo explosive, flammable, toxic, ya illegal ho. Protection: Agar kisi ke ghar mein rent pe liye gaye cylinder ya chemical se aag lagti hai, toh Aaxzo zimmedar nahi hoga. 37. Health & Hygiene (Safaai ki Zimmedari) Point: Kuch items jaise costumes, medical equipment, ya beds ke liye Owner zimmedar hai ki wo saaf aur sanitized ho. Protection: Agar Renter ko purane kapdon se skin allergy ya medical equipment se infection hota hai, toh wo Owner ka masla hai, Aaxzo ka nahi. 38. Maintenance & Recalls (Manufacturing Defects) Point: Agar koi product (jaise car ya electronics) company ki taraf se "Recall" hua hai, toh Owner use rent pe nahi chadha sakta. Owner ko saaman "Working Condition" mein maintain karna hoga. Protection: Agar rent ki bike ka break fail ho jaye kyunki service nahi hui thi, toh Owner legal zimmedar hoga. 39. Statutory Permissions (Sarkaari Ijaazat) Point: Kuch cheezein rent pe dene ke liye license chahiye hota hai (jaise Commercial Taxi ya Drones). Owner confirm karta hai ki uske paas zaroori permissions hain. Protection: Agar police bina permit ki commercial gaadi pakadti hai, toh fine Owner bharega. 40. No Agency or Partnership (Koi Rishta Nahi) Point: Aaxzo par register hone ka matlab ye nahi ki Owner hamara partner ya agent ban gaya hai. Protection: Owner kisi teesri party ko ye nahi keh sakta ki "Main Aaxzo ka banda hoon" aur koi galat deal nahi kar sakta. 41. Usage Location Restrictions (Sarhad ki Seema) Point: Owner likh sakta hai ki saaman sirf ek fix area (e.g., Delhi-NCR) mein hi use hoga. Protection: Agar Renter bike lekar Ladakh nikal jaye aur Owner ne mana kiya tha, toh ye Agreement ka violation maana jayega. 42. Force Majeure for Return (Wapsi mein deri) Point: Agar dange, curfew, ya flood ki wajah se saaman wapas nahi ho paya, toh "Late Fee" nahi lagegi, lekin Renter ko turant Aaxzo ko inform karna hoga. 43. Recording of Disputes (Call Recording) Point: Aaxzo ke paas haq hai ki wo users ke beech ki calls (agar app ke through ho rahi hain) aur chats ko record kare aur court mein saboot ke taur pe pesh kare. 44. Platform Availability (Site Down Hone Par) Point: Agar website ya app maintenance ki wajah se 2 ghante down hai aur us beech kisi ki booking miss ho gayi, toh Aaxzo koi harjana (compensation) nahi bharega. 45. Conflict of Interest Point: Aaxzo ke employees ya unke rishtedaar agar platform use karte hain, toh unhe koi special advantage nahi milega aur wo saare rules un par bhi lagu honge.

Aaxzo.com ("the Platform") is committed to protecting your personal data. This policy explains how we collect, use, store, and safeguard your information.

1. Data Collection

To ensure a safe and trusted rental environment, we collect the following information:

  • Identity Data: Full name, Government-issued IDs (Aadhaar, PAN, Driving License).
  • Contact Data: Phone number, email address, and physical address.
  • Location Data: Real-time GPS location during active rentals to prevent theft and misuse.
  • Financial Data: Payment information processed through encrypted third-party payment gateways. Aaxzo does not store card or bank details.

2. Purpose of Use

  • Verification: To confirm the identity of Owners and Renters.
  • Trust Building: Sharing limited contact details between Owner and Renter only after booking confirmation.
  • Security: Preventing fraud, theft, misuse, and criminal activity.
  • Legal Compliance: Sharing data with police or law enforcement agencies if required under Indian law.

3. Data Protection & Sharing

  • No Sale of Data: Aaxzo does not sell or rent user data to any third-party marketing agencies.
  • Encryption: All sensitive documents and IDs are stored in encrypted form.
  • Data Retention: Data is retained only as long as necessary for service delivery or legal compliance.

Refund & Cancellation Policy

To maintain fairness and trust between Owners and Renters, Aaxzo follows a structured refund and cancellation policy.

1. Renter Cancellations

  • More than 48 hours before rental start: Full refund (excluding a small processing/service fee).
  • Between 24 to 48 hours before rental start: 50% refund. Remaining amount (after Aaxzo commission) is paid to the Owner.
  • Less than 24 hours before rental start: No refund. The Owner receives the majority share of the rental fee.

2. Owner Cancellations

  • If an Owner cancels a confirmed booking, the Renter will receive a 100% refund.
  • Frequent or unjustified cancellations may result in penalties, reduced visibility, or permanent account suspension.

3. Refunds for Damaged or Incorrect Items

  • If the item delivered is significantly different from its description or is non-functional, the Renter must report it within 2 hours of handover.
  • Upon verification, a full refund including the security deposit will be processed.

4. Security Deposit Refunds

  • The security deposit will be released within 24–48 hours after the Owner confirms safe return of the item.
  • In case of a dispute, the deposit will be held until Aaxzo’s dispute resolution team makes a final and binding decision.

Aaxzo reserves the right to modify this policy at any time. Continued use of the platform constitutes acceptance of updated terms.
